By using the StampingSimulation.com website and/or any services offered by StampingSimulation.com or its authorized partner, AutoForm Engineering GmbH, or by uploading your product design data and/or submitting personal or company information for the purposes of a quotation or in requesting a job, you are required to agree to be bound by the Terms and Conditions and the Privacy Statement as outlined in this document. If you disagree with any term or condition, you will not be able to purchase any service offered by this website. Changes may be made to this section at any time and without prior announcement. You should consult this section regularly. These Terms and Conditions form the entire contract between StampingSimulation.com and the customer on acceptance of any order.

Personal Information, Company Information, and Product Design Information Data

In order for us to be able to be able to provide a quotation or to be able to process a job, you will be required to submit both personal/company and product design information. Required information may include (but is not limited to):

• Name/Company Name
• Address Details
• Telephone Number
• Input parameters
• CAD/product design data, electronic or otherwise

How do we use your personal and product design information?

We use your personal/company and product design information to conduct business with you and provide you with the agreed services, as well as:

• To ensure our site is relevant to your needs.
• To deliver services, such as forming simulation results that you request or purchase.
• To help us create and publish content most relevant to you.
• To make available to you, the full range of products and services, including the AutoForm suite of products, to whom your details may be made available to, in compliance with the Privacy Policy.

Prerogatives

StampingSimulation.com reserves the right to make changes to the present policies at any time. We also reserve the right to exchange any information where required by law or in order to protect our property rights.

Warranty

It is acknowledged that StampingSimulation.com produces its results in part, based on the data and/or input parameters provided by the customer. Any recommendations, opinions or findings stated in the results and/or report are based on customer provided information/data. StampingSimulation.com Pty Ltd does not represent or warrant the accuracy or reliability of its report findings, results, information, content, or software from any of the services contained on this website. Specifically, no warranty is given regarding performance or correctness of the output/material data files delivered from the simulation. By using the services on the StampingSimulation.com website, the user acknowledges that services are provided using state-of-the-art software that use mathematical and physical algorithms that are not necessarily proven to be accurate or valid. Customers are responsible for any consequences relating to the subsequent use of provided results (electronic or otherwise) and assume all risks arising from or related to such use. The customer waives all claims against StampingSimulation.com Pty Ltd associated therewith.

Limitations of Liability

StampingSimulation.com Pty Ltd cannot be held responsible for any damages or losses incurred through the use of the StampingSimulation.com website, or the services provided. In addition, StampingSimulation.com Pty Ltd can not be held liable for indirect, incidental, consequential, punitive, reliance or special damages, including without limitation demands for lost profits, claims of third parties, advantage, savings or revenue of any kind or increased cost of operations. Total responsibility cannot exceed the cost paid by a client for services offered.

To the extent that a party’s liability is excluded or limited, the same also applies to its employees, representatives, affiliates and any other persons StampingSimulation.com Pty Ltd employs in the performance of such and related services.

Payment

Full payment for services rendered are due within 30 days from issuance of invoice. Jobs in progress may be put on hold for a period of up to 30 days, at which time the full quoted amount will be invoiced. In the event that a debt collection company is called in to recover over-due payments, a collection fee of 20% will be applied to the total outstanding amount.

Relationship to Third Parties

StampingSimulation.com and its authorized partner, AutoForm Engineering GmbH, as well as their employees and sub-contractors are bound by a common Privacy Policy, which is fully outlined here.

AutoForm
In order to offer the full range of products and services, StampingSimulation.com may share information as defined in subclause 1.1 with its authorized partner, AutoForm Engineering GmbH (whose principal place of business is Technoparkstrasse 1, CH-8005 Zürich, Switzerland).

Subcontractors
When applicable, information/data will be made available to StampingSimulation.com authorized subcontractors for the purposes of completing requested jobs.

Other

The names “StampingSimulation.com”, “StampingSimulation”, “SimulateLite”, and “SimulateComplete” along with any logos associated with the services provided by StampingSimulation.com are trademarks of StampingSimulation.com Pty Ltd. “AutoForm” and “EasyBlank” names and all associated logos are trade marks of AutoForm Engineering GmbH.

The StampingSimulatiom.com website may include hyperlinks to third-party websites. StampingSimulation.com has no control in this regard and thus, cannot guarantee the accuracy, reliability, nor the veracity of information published on these sites. Consequently, StampingSimulation.com cannot be held responsible for content published on third-party sites.

Furthermore, StampingSimulation.com does not accept responsibility for the halting of online services due to technical failure beyond its control. Whilst all precautions are taken in this regard, StampingSimulation.com does not accept responsibility for the unavailability of its services on the internet at any given time, nor will it accept liability for the transmission of a virus. Similarly, StampingSimulation.com does not accept responsibility for any typographical errors or other inaccuracies on its sites.

The set of rights conferred to StampingSimulation.com by the present section does not, in any way, create obligations for StampingSimulation.com. These rights may be applied entirely at the discretion of StampingSimulation.com.

The preceding terms and conditions are governed by the laws applicable in the State of Queensland, Australia. Any dispute resulting from the use of the StampingSimulation.com website will be presented before the District Court of Queensland, Australia.
